The Constitution


Title

The name of the club shall be the British Hot Rod Association or BHRA ("Club") and shall be deemed to have commenced in November 1994.

Objectives

The objectives of the club shall be:
  • To further the interest in rodding, restoring and customising motor vehicles.
  • To provide a local club for enthusiasts.
  • To be involved in the local community through activities such as fund raising.
  • To provide a pool of help for members.
  • To encourage better, safer vehicles to be built and used.
  • To afford members as many benefits & privileges as it may be possible to arrange.

The Rules


Organisation

1.1

Management. The authority and responsibility for the management of the club shall be vested in the committee.

1.2

Committee. The committee shall consist of not more than ten persons and not less than four, including a Chairman, Treasurer, Secretary and Membership Secretary. In the event of a vacancy, the committee shall have the power to appoint a club member to a temporary position on the committee until the next Annual General Meeting. The committee shall have the power to co-opt any person to advise or assist the committee on any matter it deems necessary. Such persons shall not have the right to vote at any committee meeting.

1.3

Election of the Committee. The committee shall be elected from the club members at the Annual General Meeting.

1.4

Committee Meetings. The committee shall meet at least every two months, or as and when the committee deems it necessary. Four members of the committee shall constitute a quorum.

1.5

Voting at Committee meetings. Each committee member shall be entitled to exercise one vote, except for the Chairman, who may exercise a casting vote only. No resolution shall be regarded carried unless approved by a majority of those members present.

1.6

Absence from the committee. Any committee member who shall, without sufficient reason, absent himself from three consecutive committee meetings will be understood to have resigned their position on the committee. This resignation shall be confirmed in writing to the member by the Secretary.

1.7

Resignation from the committee. Any committee member who wishes to resign their position, may do so by giving written notice to either the Chairman or the Secretary.

1.8

Club Rules. The constitution and rules of the club may be ammended by the committee at any time, but changes must be approved by the membership at a general meeting before they may be considered binding.

Finance

2.1

Banking. A bank account will be held in the club's name with a bank nominated by the committee. At least 4 members of the committee shall be authorised signatories. All monies wherever possible, shall be banked within one week of deposit with the treasurer. All cheques drawn on the account shall be signed by the treasurer, and counter-signed by one other authorised signatories.

2.2

Remuneration. Committee members shall normally provide their services without requiring remuneration.

2.3

Expenses. Any member of the club incurring authorised expenses on behalf of the club shall be entitled to reimbursement from the club.

Membership

3.1

Membership of the club. Election to the club shall be at the discretion of the committee. This will also be dependent upon the person applying for membership, completing the membership application form and payment of the currently applying membership fee.

3.2

Membership Fees. Fees shall be determined by the committee. The membership year runs from January 1st to December 31st.

3.3

Discounts. In exceptional circumstances, a discounted membership fees may be offered at the discretion of the membership secretary.

3.4

Renewals. Renewals will be due on January 1st.

3.5

Non Payment. Any member who has not renewed their membership within one month of the due date will be removed from the register.

3.6

Resignation. Any member wishing to resign may do so by giving notice to the membership secretary in writing.

Meetings

4.1

Annual General Meeting. The Annual General Meeting shall take place no later than December 1st each year, at a place decided by the committee. The AGM shall:

  • Receive the treasurers report.
  • Receive the chairmans report.
  • Elect a new committee.
  • Decide upon any resolution submitted prior to or during the meeting.
4.2

Extraordinary General Meetings. Any member has the right to request an Extraordinary General Meeting. The request shall be made in writing to the secretary. The decision whether to call an EGM shall rest with the committee. If the request is declined a full explanation will appear in the newsletter.

4.3

Voting at meetings. All members have the right to a single vote at any meeting, except for the Chairman, who may exercise a casting vote only. A simple majority of votes shall decide a resolution.

4.4

Club Nights. Club nights will be held on a regular basis as directed by the committee. If a club night is due to coincide with a public holiday or another event, it may be postponed or cancelled by the committee.

Personal Conduct

5.1

Abusive Behaviour. Any member found being physically or verbally abusive to any other member or guest of the club, will be expelled from the club and forfeit their membership fee. If this behavior continues, the committee may involve the police at their discretion.

5.2

Theft and Criminal Damage. Any member found stealing or wilfully damaging club property, will be expelled from the club and forfeit their membership fee. The decision whether to involve the police, or instigate any civil action to seek recompense shall rest with the committee.

5.3

Guests. Any member who brings a guest to a club meeting or event will be held responsible for the behaviour of that guest.

5.4

Disorderly Conduct. Any member or guest acting in an antisocial, or disruptive manner at a club meeting or event may be asked to leave by the committee.

5.5

Alcohol. The club reserves the right to refuse to sell alcohol to any member or guest who appears intoxicated.

5.6

Public Events. Any member whose conduct at a public meeting or event reflects badly on the image of the club may be issued with a written warning by the committee. Any member who has already received two such warnings, may be asked to leave the club.

General Rules

6.1

Observance. Every member binds themselves to abide by the rules of the club.

6.2

Constitution. The constitution and rules of the club shall be displayed at any club night on the club notice board. Any member may request a copy from the secretary.

6.3

Dissolution. The club may be dissolved by an EGM, convened by direction of the committee. If the resolution is duly passed, all property shall be returned to the secretary, except monies and financial records which shall be returned to the treasurer. Any assets shall be sold and all monies donated to a charity of the committee's choosing.
